Terms for Using BAC Service

CHAPTER 1 GENERAL PROVISIONS
Article 1 (Purpose)

The purpose of these Terms is to provide for the rights, obligations and responsibilities between users and Bucheon Arts Center (hereinafter “BAC”) and other necessary matters in using the website provided by Bucheon Arts Center.

Article 2 (Specification and Revision of Agreement)

These Terms become effective when BAC notifies the Terms to users by posting them on the screen or by any other method. BAC may revise these Terms as necessary, and the revised Terms become effective when BAC notifies to users in the same method as above. If a user does not agree on the revised Terms, he/she may stop using the service and request withdrawal of membership, and if he/she continues to use the service, he/she shall be deemed to have agreed on change of the Terms.

Article 3 (Rules other than the Terms)

If a user agrees on the contents of these Terms, these Terms shall preferentially apply in providing the service by BAC and using the service by users. The matters not provided for in these Terms shall be, if provided for in the relevant legislation, subject to the provisions of such legislation, or otherwise subject to common practice.

Article 4 (Definition of Term)
  1. 1. User : It refers to any person who connects to BAC and received the service provided by BAC.
  2. 2. Operator : A person who manages the website of BAC to ensure overall maintenance and smooth operation of the service
  3. 3. Member : A person who has signed up for a membership after entering into the contract for using service with BAC as provided in these Terms and providing personal information as necessary to become a member, and received a member ID
  4. 4. Withdrawal : An act invalidating the validity of the contract for using service by BAC or any user after entering into such contract
CHAPTER 2 CONTRACT FOR USING SERVICE
Article 1 (Benefits of Member)
  1. 1. Information on performances, exhibitions and Academy shall be provided to members via email, Kakao Talk, SMS and DM.
  2. 2. When a member purchase tickets via the homepage of BAC, 1% of the payment amount shall be accumulated as points.
  3. 3. Accumulated points may be used by the unit of 1,000 won in advance purchase of tickets at BAC, and divided use or combined use with any other payment method is also available: Provided, that use of points may be restricted for pachage product or performance by rental, depending on the situation.
  4. 4. Points for which 3 years have lapsed from the date of accumulation shall automatically expire, regardless of use.
  5. 5. Any ticket purchased from any outside advance purchase office shall not accumulate points.
  6. 6. Points of a member can be verified at “My Page” after login.

Article 2 (Term of Validity)

The term of validity of a member shall be from the time of establishment of the contract for use according to the contents of these Terms till termination of the contract by the intent of the user.

Article 3 (Change of Matters in Contract)

When any matter which a member has stated at the time of initial application for use has been changed, the member shall directly amend it, and the member shall be responsible for any problem caused by the failure to amend it.

Article 4 (Policy for Dormant Members)

Pursuant to the Act on Promotion of Information and Communications Network Utilization and Information Protection, Bucheon Arts Center implements the policy on dormant members who have not used the service for a long period of time as below:

  1. 1. If a member has not logged in the website of Bucheon Arts Center for 1 year shall be changed to dormant status.
  2. 2. No later than 30 days from being changed to dormant status, an email and text informing changing to dormant status shall be sent.
  3. 3. For members changed to dormant status, their personal information shall be separated and safety stored.
  4. 4. Personal information separately stored shall not be used for any purpose other than release from dormant status (application for reuse of ID) or unless otherwise provided in any other legislation.
  5. 5. If a member logs in the website within 1 year after being changed to dormant status, the dormant status shall be automatically released.
  6. 6. If a member has not logged in for 1 year after being changed to dormant status, the relevant member shall be automatically treated to have withdrawn the membership.
CHAPTER 3 PROVISION AND USE OF SERVICE
Article 1 (Use of Service)
  1. 1. BAC shall start its service from the time it accepts application for use by a member.
  2. 2. It shall be a rule that service can be used 24/7 throughout the year: Provided, that provision of service may be temporarily suspended due to business or technical failure, regular check-up, or any other force majeure reason. In such a case, BAC shall give a prior or ex post facto notice thereof to the members.
Article 2 (Restriction on Use of Service)
  1. 1. A member may request withdrawal of membership at any time, and BAC shall immediately process withdrawal of membership.
  2. 2. If a user has registered any false information at the time applying for the membership, is involved in any criminal act, has intentionally interrupted operation of service, illegally used the ID and password of any other person, or defamed or given any disadvantage to any other person, BAC may suspend or restrict his or her membership qualification.
Article 3 (Provision of Information)
  1. 1. BAC may provide various information as deemed necessary in using the service by members to members by posting in the site, by sending email or SMS to members.
  2. 2. If a member does not want to be provided with any information, he or she may refuse to receive information.
Article 4 (Member’s Posting and Elimination)

If any content posted or registered by members are deemed to fall under any of the following subparagraphs, BAC may eliminate it without a prior notice, for which BAC does not assume any responsibility:

  1. 1. Where it is against national safety or security;
  2. 2. Where it has any political or inclination;
  3. 3. Where it slanders any specific agency, organization or department without any ground;
  4. 4. Where it is likely to slander or defame any specific person;
  5. 5. Where it is a commercial advertisement for profit making or may infringe any copyright;
  6. 6. Where it is any unsound content such as curse or pornography; or
  7. 7. Where it is not consistent with the purpose of the relevant bulletin board.
Article 5 (Copyright of Posting)
  1. 1. The rights and responsibilities for any posting shall lie with the publisher, and BAC shall not use the posting for profit making except for posting within the service.
  2. 2. A member shall not use any information obtained using the service in performance, broadcasting, exhibition, publication, distribution, etc. or provide to any third person after reproduction, processing, translation, etc.
  3. 3. Any civil or criminal liability resulting from infringement of the copyright of any other person by the posting of any member shall be solely borne by the member.
CHAPTER 4 OBLIGATIONS OF PARTIES TO CONTRACT
Article 1 (Obligations of Operator)
  1. 1. Unless there is any special situation, BAC shall ensure that a member can use the service on the commencement date of service requested by the member.
  2. 2. BAC is obligated to continuously and stably provide the service as provided in these Terms.
  3. 3. BAC shall endeavor to protect personal information of its members as provided in the relevant legislations, and it shall comply with the provisions of the relevant legislations and the policy for collection and processing of personal information for protection of personal information of the members.
Article 2 (Obligations of User)
  1. 1. A member shall comply with the relevant legislations and the matters including but not limited to these Terms notified by BAC, and shall not conduct any act which may disturb the business of BAC.
  2. 2. A member shall not assign, give or provide as security his or her ID and password to any other person.
  3. 3. A member shall not conduct any of the following acts in relation to using the service:
    • 1) Any act of improper use of the ID of any other member;
    • 2) Any act of reproduction of any information obtained from the Service for any purpose other than use by the member, or using such information in publication and/or broadcasting, or providing to any third person without a prior consent of BAC;
    • 3) Any act of infringing the copyrights of BAC or any other rights such as the copyrights of any third party;
    • 4) Any act of registering or distributing virus-infected materials that may cause malfunction of information and communication facilities and destruction and/or confusion of information;
    • 5) Any act objectively deemed to be connected with crimes; or
    • 6) Any other act in violation of the relevant legislations or terms of use as provided by BAC.
Article 3 (Advance Purchase Service and Cancellation and Refund)
  1. 1. BAC shall provide advance purchase service via internet, which shall be subject to the details as specified in the homepage of BAC.
  2. 2. Cancellation and refund for tickets purchased in advance shall be subject to the regulation for operation of tickets of BAC.
  3. 3. Cancellation and refund for tickets purchased in advance at any advance purchase office linked to BAC shall be available at the advance purchase office from which tickets were purchased, which shall be subject to the provisions of the linked advance purchase office.
CHAPTER 5 MISCELLANEOUS
Article 1 (Competent Court)

If any dispute and/or lawsuit is raised between the operator and any user in connection with this service, the court under the jurisdiction of the seat of the head office of BAC shall be the exclusive competent court.
